1. Acceptance of Terms
By downloading, installing, or using the Sabah app ("Sabah", "the app", "we", "our"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the app.
These Terms apply to all users of Sabah on both iPhone (through the Apple App Store) and Android (through Google Play), including free and premium subscribers.
2. About Sabah
Sabah is a wellness application designed to support a daily morning ritual of approximately ten minutes, combining a check-in, breathwork, movement sequences, and a daily philosophical thought. Sabah is intended for general wellness purposes only and does not constitute medical advice, diagnosis, or treatment.
3. Eligibility
You must be at least 13 years of age to use Sabah. By using the app, you represent and warrant that you meet this requirement. If you are under the age of 18, you must have parental or guardian consent.
4. Account
To use Sabah, you must create an account using one of the sign-in methods offered in the app. On iPhone, Sign in with Apple is available. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to notify us immediately at hello@sabahapp.com if you become aware of any unauthorised access to your account.
We reserve the right to suspend or terminate your account at our discretion if we believe you have violated these Terms.
5. Subscription and Payments
5.1 Free Tier
Sabah offers a free tier that includes access to the Gentle Wake movement sequence and Box Breathing. No payment is required to access the free tier.
5.2 Premium Tier
Premium access unlocks all movement sequences, all breathwork protocols (including 4-7-8 and Energising Breath), and the full daily philosophical thought library. Premium is available as a monthly or annual subscription. New users receive seven days free with everything unlocked.
5.3 Billing
If you subscribe on iPhone, your subscription is billed through Apple's in-app purchase system and is subject to Apple's terms. If you subscribe on Android, your subscription is billed through Google Play Billing and is subject to Google Play's terms. In both cases your subscription renews automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date.
5.4 Cancellation
You may cancel at any time. On iPhone, cancel through your Apple ID subscription settings. On Android, cancel through your Google Play subscription settings. Cancellation takes effect at the end of your current billing period, and you keep premium access until that date. Refunds are handled by Apple or Google under their own policies; we do not offer refunds for partial subscription periods except as required by applicable law.
5.5 Price Changes
We reserve the right to change subscription prices at any time. We will provide reasonable advance notice of any price change. Your continued use of a premium subscription after a price change constitutes acceptance of the new price.
6. Acceptable Use
You agree to use Sabah only for lawful purposes and in accordance with these Terms. You agree not to:
- Reproduce, distribute, modify, or create derivative works of any app content without our express written permission
- Attempt to reverse engineer, decompile, or disassemble the app
- Use the app in any way that could damage, disable, or impair its functioning
- Attempt to gain unauthorised access to any part of the app or its servers
- Use the app for any commercial purpose without our prior written consent
7. Intellectual Property
All content within Sabah — including but not limited to movement sequences, breathwork audio and video, philosophical thought curation, graphic design, typography, and the Sabah name and logo — is owned by or licensed to Sabah and is protected by applicable intellectual property laws.
Your use of the app does not grant you any ownership rights in any content. You may not use, reproduce, or distribute any content from the app without our express written permission.
8. Health and Wellness Disclaimer
The content provided in Sabah — including movement sequences, breathwork protocols, and philosophical content — is for general wellness and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment.
Before beginning any new physical or breathwork practice, consult a qualified healthcare professional, particularly if you have any pre-existing health conditions, are pregnant, or have recently had surgery or an injury. By using Sabah, you acknowledge that you do so at your own risk.
If you experience pain, dizziness, shortness of breath, or any adverse symptoms during a session, stop immediately and seek appropriate medical attention.
9. Limitation of Liability
To the fullest extent permitted by applicable law, Sabah and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app, even if we have been advised of the possibility of such damages.
Our total liability to you for any claims arising from your use of the app shall not exceed the amount you have paid to us in the 12 months preceding the claim.
10. Disclaimer of Warranties
Sabah is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the app, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the app will be uninterrupted, error-free, or free of harmful components.
11. Third-Party Services
Sabah integrates with third-party services including Firebase (Google), Apple's App Store and in-app purchase system, Google Play and Google Play Billing, Resend for email delivery, and Vimeo for video playback. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party service.
12. Termination
We may terminate or suspend your access to Sabah at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the app will immediately cease.
You may stop using Sabah at any time by deleting the app from your device and cancelling any active subscription through the App Store or Google Play.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of Sabah shall be subject to the exclusive jurisdiction of the competent courts.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via an in-app notification or by updating the effective date at the top of this document. Your continued use of Sabah after changes constitutes acceptance of the updated Terms.
